Experience

Representing Moller Mobility group companies – distributors of VW cars in Latvia - in litigation with Latvia’s Competition Council, where the court has repealed a EUR 7.4 million fine imposed on our clients for an alleged cartel agreement.

Representing Moller Baltic Import SE, the sole importer of VW cars in the Baltics, and Moller Group’s dealers in litigation challenging the decision of the Latvian Competition Council to fine the Moller Group with a record fine of EUR 7.4 million. Upon our request, the administrative court has stayed the proceedings and referred a question to the Constitutional Court. This is the first instance that a competition law issue has been referred to the Constitutional Court.

Representing Iveco Group companies in a dispute worth EUR 0.63 Mio against its previous dealer Ive Motors SIA, which became insolvent. The dispute involved several complex legal aspects concerning the jurisdiction, applicable substantive law and others.

Advising KW Bruun OU, the Peugeot car importer into the Baltic States, on compliance of their distribution agreements with competition law.

Advising Auto Halle, a distributor of Suzuki, Peugeot, Seat, Hyundai and Isuzu cars in Latvia, in distressed situation arising from EUR 5 Mio loan issued by Swedbank. We assisted with the negotiations with the bank, legal protection proceedings, insolvency process, project planning and eventual refinancing of the company.

Advising IVECO Group in negotiations with a Latvian debtor in handling various aspects of insolvency, guarantee enforcement and further financing of the supplied vehicles as well as Latvian litigation procedure. The amount of debt was in excess of EUR 0.6 Mio.

Acting jointly with Lindahl and TALI Network, our law firm assisted Littelfuse, a NASDAQ listed US company, in acquiring a company Accel, a Swedish owned Lithuanian company. The transaction support was provided in carrying out legal due diligence and transaction support. Accel is a global leader in manufacturing of sensors, switches and control units for key industry players: Volvo, GM, BMW, Daimler, Maybach, Jeep, Cadillac.

Assisting Avtokraz, a leading manufacturer from Ukraine, in dealing with distressed Parex Banka and newly established Citadele banka regarding repayment of the deposit or its conversion into Eurobonds issued by Citadele. The client’s claim was in excess of EUR 15 Mio.
