Representing Rimi Latvia SIA in two administrative litigation cases challenging the decisions of the Latvian Competition Council to prohibit opening of a “Rimi” hypermarket in the shopping mall “Domina” (one of the biggest shopping malls in the capital of Latvia), but allowing the client’s competitor Maxima Latvija SIA to acquire lease rights of the same premises. Previously the premises were leased by another supermarket chain operator Prisma Latvija AS, therefore the transactions were subject to merger control.
Representing Moller Baltic Import SE, the sole importer of VW cars in the Baltics, and Moller Group’s dealers in litigation challenging the decision of the Latvian Competition Council to fine the Moller Group with a record fine of EUR 7.4 million. Upon our request, the administrative court has stayed the proceedings and referred a question to the Constitutional Court. This is the first instance that a competition law issue has been referred to the Constitutional Court.
