Lithuania: public procurement – only for reliable tax payers.

The Law on Public Procurement will be amended on 1 January 2019. Suppliers who do not meet the minimum criteria for reliable taxpayers, will not be able to participate in public procurement. This amendment directly relates to amendments to the Law on Tax Administration, which has been supplemented with Article 401  and sets the minimum criteria for reliable taxpayers in order to strengthen the selection of suppliers in public procurement.

Under new Lithuanian tax laws, a reliable tax payer is the one who:
1)      is keeping records and managing taxes responsibly and in time;
2)      is not punished for illegal employment;
3)      was not convicted of fraud, unjust enrichment, criminal activity for the economy and business, criminal activity in the financial system.

Non-compliance with the new criteria for reliable taxpayers will be considered a commitment of gross professional misconduct. Therefore, more criteria will be included  in the Law on Public Procurement to ensure reliability of the suppliers willing to participate in public procurement.
