Competition Law: A company can be fined for the conduct of the consultant, who prepares the tender documentation

Court of Justice of the European Union just recently concluded, that it is possible to establish a violation of the competition law not only because of the company’s own acts, but also the ones of the consultant contracted for the preparation of the tender documents.
