Brand owners should consider possibility to seize goods in transit through Baltic ports.

Proprietors of EU trademarks have the right to prevent counterfeit goods from entering the EU, even if these goods are in transit with final destination in a non-EU country. The customs can take action, provided that the brand owner holds a valid trademark right also in the country of final destination of the relevant shipment. Brand owners are therefore urged to file applications with the customs to enable seizures. VILGERTS intellectual property team is ready to assist with required applications and procedures before the customs offices.

Feedback from the EU Member States gathered by the European Commission on the customs enforcement of intellectual property rights can be found at http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=COM:2017:233:FIN
